Please read these Terms and Conditions (“Terms”) carefully before using NexiaTalk and the underlying FastTurn WebRTC network. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use NexiaTalk.

1. About NexiaTalk

NexiaTalk is a professional, browser-based communication platform for secure, one-to-one text and video sessions.

The Service consists of:

• The web application accessible via https://nexia.talk
• The global FastTurn WebRTC network (fastturn.pro), which routes and relays encrypted traffic between participants

NexiaTalk is intended for professional use in medical, therapeutic, coaching, and consulting environments.

2. About the FastTurn WebRTC Network

NexiaTalk relies on the FastTurn WebRTC network, a global infrastructure of STUN/TURN servers operated by FoxyFy.

All media traffic between participants is routed through this network for optimal global performance, low latency, and reliable connectivity.

The network does not store audio, video, or message content. Only minimal connection metadata is processed for WebRTC functionality.

3. Eligibility

To use NexiaTalk, you must:

• Be at least 18 years old
• Use the Service only in lawful and professional contexts
• Provide accurate registration and payment information
• Agree to these Terms

4. Scope of the Service

NexiaTalk provides:

• Secure one-to-one video and text communication
• Access to the global FastTurn WebRTC network
• Session scheduling and management tools
• Browser-based operation without downloads
• Encrypted peer sessions (where browser-supported)
• TURN-relay fallback for difficult network environments

NexiaTalk does not provide:

• Medical services, diagnosis, or emergency communication
• A guaranteed SLA or constant uptime
• Unlimited bandwidth or unrestricted TURN usage

5. Fair Use

To ensure stable operation, the Service is subject to fair use limitations. Excessive bandwidth consumption, automated traffic, credential abuse, or behavior that impacts system stability may result in throttling, suspension, or termination.

Normal professional session usage is permitted without restriction.

6. Pricing and Payments

NexiaTalk is offered as a paid subscription (e.g., annual personal license). Pricing and renewal terms are provided during checkout.

Payments are processed securely via third-party providers. Subscriptions remain valid for the purchased period. No refunds are provided unless required by law.

7. Account Responsibilities

You are responsible for keeping your login credentials secure and ensuring that only authorized individuals access your account.

Any activity performed from your account is considered authorized by you. Sharing login details is prohibited.

8. Content and Data Responsibility

You are solely responsible for all communications and data exchanged through NexiaTalk.

You must not use the Service to transmit:

• Illegal or harmful content
• Copyright-infringing material
• Malicious code, spam, or abusive traffic

NexiaTalk does not monitor session content, but may act on reports of unlawful use.

9. Intellectual Property

All NexiaTalk software, branding, and the FastTurn network infrastructure are the intellectual property of Chris Ahrweiler.

You retain full ownership of your session content, client data, and materials transmitted through the Service.

10. Disclaimer of Warranties

NexiaTalk and the FastTurn network are provided on an “as is” and “as available” basis. No guarantees are made regarding:

• Continuous availability
• Connection success or stability
• Data integrity or delivery

11. Limitation of Liability

To the fullest extent permitted by law, NexiaTalk and its owner are not liable for indirect or consequential damages, including:

• Loss of data or connectivity
• Service interruptions or downtime
• Loss of revenue or reputation

Total liability is limited to the amount paid by you in the preceding 12 months.

12. Termination

NexiaTalk may suspend or terminate access if:

• You violate these Terms
• Illegal or harmful use is detected
• Credential abuse or excessive traffic occurs

Upon termination, access credentials may be revoked immediately.

13. Legal Compliance & Takedowns

You agree to comply with all applicable laws, including GDPR and German telecommunication law.

Valid legal requests will be honored. To file a complaint or takedown request, contact info@nexia.talk.

14. Data Protection & Privacy

NexiaTalk processes minimal data necessary to operate the Service, including:

• IP addresses
• Connection metadata
• Authentication credentials
• Subscription and account information

No audio, video, or message contents are recorded or stored. TURN relay servers do not retain transmitted media.

15. Changes to These Terms

NexiaTalk may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Düsseldorf, Germany.
